In the recent verdict passed by Supreme Court on September 26th, the declaration made that it is not obligatory to provide Aadhaar to register or appear for national levels entrance exams like National Eligibility cum Entrance Test (NEET), University Grants Commission (UGC) and other Central Board of Secondary Education (CBSE) exams. It is also not mandatory to produce Aadhaar card to take admissions in schools either private or government. Earlier in this month NTA also ruled out the need of Aadhaar Card for registration of JEE Main.
While releasing the verdict for media, Justice Sikri announced that "CBSE, NEET, UGC making Aadhaar mandatory is not feasible and they cannot do so. For the enrollment of children, it would be essential to have the consent of parents." The honourable court further added that Aadhaar cannot be made mandatory for school admissions as well.
The Supreme Court, however, has not denied to the constitutional validity of Aadhaar, and it also listed down in some sections of the Act. The bench consisting of five-judges including Justices A K Sikri, A M Khanwilkar, D Y Chandrachud and Ashok Bhushan, It was headed by Dipak Misra who is Chief Justice of India (CJI) said that "education has taken us from thumb impression to signature, now technology has taken us from signature to thumb impression". The bench underlined that for enrollment of children in Aadhaar it would be compulsory to have consent from the parents. They will be given choice to exit while attaining the age of 18, the court further added into the statement.
The apex court is totally in consent with the fact that Aadhaar is secure and unique. Justice AK Sikri in support of that said that "It is better to be unique than the best. Aadhaar has become the most talked about expression in the recent years,"
Prior this year, a Constitution Bench of the Supreme Court had released a CBSE warning that made Aadhaar or its enrolment verification compulsory to enrol or show up for the National Eligibility cum Entrance Test (NEET) 2018.
The respected court had requested the CBSE, the authority responsible for conducting NEET, to publish the court order onto their main website.
