The U.S. Department of Homeland Security (DHS) will replace the F-1 visa "Duration of Status" rule with a fixed stay period starting September 15, 2026 . This change affects international students, including those from India, studying in the U.S.
New Fixed Stay Period for F-1 Visa Holders
Under the new rule, F-1 visa students will be admitted for a maximum of four years . This period includes an additional 30 days upon arrival and 30 days after program completion for departure. The DHS published this final rule on July 17, 2026.
Previously, students could remain in the U.S. for an unspecified period to complete their studies. This "Duration of Status" provision is now replaced by the fixed stay limit.
Implications for Indian Students
Indian students in Student and Exchange Visitor Program (SEVP) certified schools must now apply for an Extension of Stay (EOS) . This is required if they need more time to finish their studies, start a new program, or participate in Optional Practical Training (OPT) and STEM OPT.
The approved study duration, up to four years plus the grace periods, will be printed on the student's Form I-20, "Certificate of Eligibility for Nonimmigrant Student Status."
Key Changes in the Final Rule
The new rule allows students 30 days after course completion to apply for extensions or lawful status in the U.S. The previous departure grace period was 60 days.
Students in their first year of a program below graduate level cannot change their educational level or major without SEVP authorization. They also cannot switch from a Master's to a Bachelor's program, or a Bachelor's to another Bachelor's program.
Students in graduate-level programs or higher cannot change their educational level or major at any point. Similarly, students in programs below graduate level cannot transfer schools during their first year.
Students in graduate programs or above are ineligible to transfer schools at any stage of their studies. SEVP may grant exceptions for extenuating circumstances.
Program-Specific Limitations
Students enrolled in English language courses are limited to a 24-month study period . This is in addition to the 30-day departure grace period.
Students attending public high schools, charter schools, or taxpayer-funded schools have a 12-month aggregate limit for their studies. This includes academic breaks and school vacations.
Border commuter students will continue to be admitted for a fixed period.
