The Supreme Court of India has recently given a clear order: universities must fully follow rules set by the University Grants Commission (UGC) if they have adopted them. This means universities cannot pick and choose which rules to follow.

This important decision came from a case involving Banaras Hindu University (BHU) . The court said that once a university accepts UGC rules, it must apply them completely and always, especially in important processes like hiring teachers and setting academic standards.

Why This Case Happened

The Supreme Court looked into a challenge against how BHU hired assistant professors in 2013 . Some people who applied for these jobs argued that BHU’s way of giving marks for academic records, teaching skills, and interviews was not correct. They said BHU’s method did not match the rules laid out in the UGC Regulations of 2010 . This complaint was reported byLive Law.

Experts in university hiring say such issues are common. Many universities often adopt UGC rules but then make small changes over time. This happens because committees might rely on older ways of doing things. The Supreme Court's judgment makes it clear: if a university says it follows UGC rules, it has to follow them fully , without any changes.

BHU's Adoption of UGC Rules

The court noted that BHU had officially adopted the UGC’s 2010 Regulations in August 2010 . This means BHU agreed to follow these rules. The Supreme Court said that once a university adopts such rules, they stay in effect. They remain valid unless the university decides to change to a completely different set of guidelines, which must also be proper and transparent.

The court also clarified that any new changes or updates to the UGC Regulations (called amendments) also apply automatically. This leaves no room for universities to choose only some parts of the rules they like. They must accept the rules as they are, including any future updates from the UGC.

What are UGC Regulations?

The University Grants Commission (UGC) is a main body in India that helps maintain standards for higher education. It makes rules and guidelines for universities across the country. These rules cover many things, like how to hire teachers, what qualifications teachers need, how to admit students, and what courses to offer. These rules help make sure that all universities offer good quality education and fair processes.

Impact on Other Universities

This decision from the Supreme Court is expected to have a big effect on universities all over India. Many state and central universities are currently hiring or have faculty selections pending. Institutions that have been using a mix of different procedures will now need to change their ways. They will have to make sure their hiring methods exactly match the UGC Regulations that were valid at the time they announced the job openings or made selections.

Because of this ruling, many universities are likely to look back at their past hiring processes. They will do this to check if they followed all rules correctly. This review will help them avoid new legal problems or challenges in the future. The judgment ensures that fairness and common standards are maintained across all universities that follow UGC guidelines.

This ruling is a reminder to all educational institutions about the importance of following rules consistently. It aims to bring more clarity and fairness to the hiring of teachers and other academic activities in India's higher education system.
